These Terms of Use (“Terms”) govern access to Sugar-Daddy.com.au and any related website, mobile web experience, account, communication or membership feature we make available (together, the “Service”). By using the Service, you agree to these Terms.
You must be at least 20 years old and legally able to enter a contract. The Service is for lawful, consensual communication between adults.
1. Acceptance and changes
Read these Terms together with our Privacy Policy, Cookies Policy and Safety Guide. If you do not agree, do not use the Service. We may update these Terms for legal, security or operational reasons. Material changes will be notified where appropriate, and continued use after the effective date means the updated Terms apply.
2. Eligibility
You may use the Service only if you are 20 or over, can form a binding contract, are not prohibited by law from using it and have not been removed for a serious or repeated breach. You must not allow anyone under 20 to access an account or create an account for another person without authority.
3. What the Service does
The Service provides tools intended to help adults publish profiles, discover other members and communicate. We are not a party to interactions between members and do not guarantee compatibility, identity, conduct, background, availability or any particular outcome. Profile moderation and reporting tools reduce risk but cannot remove every risk.
4. Accounts and profile accuracy
You are responsible for accurate account information, for keeping sign-in details confidential and for activity conducted through your account. Tell us promptly if you suspect unauthorised access. Profile photographs must depict the account holder unless clearly identified and permitted, and profile information must not impersonate, mislead or infringe another person’s rights.
5. Member conduct
You must communicate respectfully, lawfully and consensually. You must not:
- harass, threaten, exploit, stalk, discriminate against or intimidate another person;
- request or share sexual content involving a minor, or facilitate any unlawful activity;
- impersonate another person, use deceptive profile information or submit content you do not have permission to use;
- solicit money through deception, run a scam, distribute malware, harvest data or attempt unauthorised access;
- publish another person’s private contact, financial, location or identity information without permission;
- send spam, unauthorised promotions or repeated unwanted messages;
- use automated scraping, bots or bulk account tools without our written permission;
- circumvent a block, suspension, security control or moderation decision.
We may review reports, restrict visibility, remove content, suspend or close accounts, and preserve or disclose relevant records where reasonably necessary for safety, enforcement or legal compliance.
6. Member content
You retain ownership of content you submit. You give us a non-exclusive, worldwide, royalty-free licence to host, reproduce, resize, display and otherwise use that content only as reasonably needed to operate, secure, moderate and improve the Service. This licence ends when the content is deleted, except for cached copies, safety records, lawful retention and content already shared with others.
You confirm that you have the rights and permissions needed to submit your content and that it complies with these Terms.
7. Memberships, payments and cancellation
Any paid feature, price, billing period, renewal term and material restriction will be shown before purchase. You authorise the stated charge when you complete a purchase. If recurring billing is offered, the checkout must explain the renewal schedule and how to cancel before you agree.
You may cancel future renewal through the method stated at purchase or by contacting us. Cancellation does not remove rights or remedies available under the Australian Consumer Law. Refunds and other remedies will be provided where required by law; nothing in these Terms excludes, restricts or modifies a right that cannot lawfully be excluded.
8. Safety and offline meetings
You decide whether and how to communicate or meet another member. Use caution, protect private and financial information, use a public place for a first meeting, arrange independent transport and tell a trusted person your plans. Read the Safety Guide. We do not provide emergency services. Unless expressly stated for a specific feature, we do not promise criminal, identity, employment or financial background checks.
9. Intellectual property
The Service design, branding, software, text and other materials supplied by us are owned by us or our licensors and protected by applicable law. You may use them only for personal access to the Service. You must not copy, sell, reverse engineer or commercially exploit them except where law permits.
10. Third-party services
The Service may link to or rely on third-party hosting, payment, communications or content services. Their separate terms and policies may apply. We are not responsible for a third party’s independent acts, but this clause does not remove any responsibility we have under applicable law.
11. Consumer guarantees and liability
Services supplied to Australian consumers may include guarantees under the Australian Consumer Law, including that services are provided with due care and skill and are fit for a disclosed purpose. These Terms do not exclude or limit those guarantees or any other right that cannot lawfully be excluded.
To the maximum extent permitted by law, we are not liable for indirect or consequential loss that was not reasonably foreseeable, or for loss caused by another member’s independent conduct outside our reasonable control. Any permitted limitation is subject to mandatory consumer rights.
12. Suspension and termination
You may stop using the Service at any time. We may restrict, suspend or close an account for a breach, a safety risk, unlawful conduct, non-payment, technical security or where required by law. Where appropriate, we will give notice and a reasonable opportunity to respond, unless immediate action is needed to protect people, the Service or evidence.
13. Governing law and disputes
These Terms are governed by the laws applicable in Australia and the state or territory connected with the Service operator, subject to any mandatory rights in your place of residence. Contact us first so we can try to resolve a concern promptly. You may also have rights to contact your state or territory consumer protection agency.
